1. About these Terms

Wear-It-Loud.com is operated by Wear It Loud, Norridgewock, Maine. You can reach us at info@wear-it-loud.com.

You must be at least 18 years old, or have a parent or guardian's permission, to place an order or create an account. We currently ship within the United States only.

2. Accounts and security

Some parts of the Site, including support tickets, prize games, the affiliate program and the drop shipping program, need an account. When you create one, give accurate information and keep it up to date. We may ask you to verify your email address before you can sign in.

You are responsible for keeping your password private and for everything done through your account. Tell us right away if you think someone else has used it. One person should have one account. We may suspend or close accounts that are fake, shared, abused, or used in breach of these Terms.

3. Orders, prices and payment

All prices are in US dollars. When you place an order you are making an offer to buy. We accept it when we confirm payment and begin processing it. We may refuse or cancel any order, for example because of a pricing or stock error, a problem with your artwork, suspected fraud, or a payment that did not go through. If we cancel an order you have already paid for, we will refund it in full.

Sales tax, where it applies, and shipping are calculated at checkout from your shipping address and the shipping method you choose, and are shown in your order summary before you pay.

Card payments are processed securely by Stripe. We never see or store your full card number. Other payment methods, if we offer them, are described at checkout.

If we send you a quote or an invoice, it is valid only for the period shown on it. Accepting a quote turns it into an invoice, which you must pay before we begin work.

4. Shipping and delivery

Our Shipping policy explains processing times, carriers and shipping options. Delivery dates are estimates and are not guaranteed, because carriers can be delayed. Please check your shipping address carefully. We are not responsible for orders sent to an address that was entered incorrectly. If a package is lost or arrives damaged, contact us as soon as you can so we can help sort it out.

5. Custom and printed products

Many of our products, including DTF transfers and items printed with your artwork, are made to order. Please note:

  • Colors can look different on a screen than in print. Small differences in color, placement and size are normal and are not defects.
  • We print the file you give us. We do not correct spelling, resolution or layout, although we may warn you if a file looks too small or low quality. Low-resolution files can print blurry.
  • DTF transfers need the right heat, pressure and time to apply properly. We are not responsible for results caused by improper application or care. Follow the instructions that come with your order.
  • Production starts soon after payment. If you need to change or cancel a custom order, contact us right away. We cannot cancel once printing has started.

6. Your artwork and copyright

If you upload artwork, text, logos or any other material for us to print ("Your Artwork"), you promise that you own it or have permission to use it, and that printing it will not infringe anyone's copyright, trademark, privacy or other rights.

You give us a limited, non-exclusive permission to copy, adjust and print Your Artwork only so we can make and deliver your order, and to keep a record of it for support and reprints. You keep ownership of Your Artwork.

We may refuse, pause or cancel any order that contains material we believe is unlawful, infringing, hateful, obscene, or otherwise not something we are willing to print. We will refund an order we refuse for this reason. If you believe something on the Site infringes your rights, email us at info@wear-it-loud.com with details and we will look into it promptly.

7. Returns, replacements and refunds

Custom items are final sale. Made-to-order and personalized items, including custom DTF transfers and anything printed with Your Artwork, cannot be returned or exchanged because you changed your mind, ordered the wrong size or quantity, or prefer a different color.

If we got it wrong, we will fix it. If your order arrives damaged, defective, misprinted compared with the artwork you approved, or is not what you ordered, contact us within 30 days of delivery at info@wear-it-loud.com or open a support ticket. Include your order number, a description of the problem, and clear photos of the item (and the packaging, if it was damaged in transit). We will send a free replacement or give you a full refund to your original payment method, and we will cover the return shipping.

Not covered: problems caused by low-resolution or poor-quality files you supplied, mistakes in Your Artwork, improper heat-press application or care, normal color variation, or ordinary wear.

Ready-made (non-custom) items can be returned within 30 days of delivery if they are unworn, unwashed and in their original condition with all original tags attached. Contact us first so we can approve the return and tell you where to send it. You pay return shipping unless the return is because of our error. After we receive and inspect the item, we issue the purchase price as store credit to use on a future order, usually within 5 to 7 business days. We do not refund standard returns to the original payment method, and original shipping charges are not refunded, unless the return is because of our error or the law requires it.

Our Returns policy page has the step-by-step instructions and the return address. If it ever conflicts with these Terms, these Terms apply.

8. Prize games and promotions

From time to time we run prize games where signed-in customers earn points for taking part. These rules apply along with the rules and prize details shown on each game's page.

  • Who can play: signed-in customers who are 18 or older and live in the United States, unless a game page says otherwise. Store staff cannot play. One account per person.
  • No purchase necessary. Buying something is never required to play or to win. Every game lists free ways to earn points, such as a daily check-in. Purchases may earn extra points where a game says so, but they are not needed to take part.
  • Points are entries. Each point is one entry in that game's draw. Points have no cash value, cannot be sold or transferred, and end when the game ends.
  • Entering the game. You must press "Enter the game" before you earn anything. When you do, qualifying paid orders you placed while the game has been running are added automatically, and new paid orders are credited as they happen. Points from an order that is refunded or cancelled are removed.
  • Sharing links. Points for sharing are given only when another real person clicks your personal link. Fake clicks do not count.
  • The draw. After a game ends we draw one winner at random. The draw is weighted by points, so more points mean better odds, but no number of points guarantees a win. The draw is recorded.
  • The winner. We contact the winner by email. If we cannot reach the winner, or they do not respond within a reasonable time, we may draw again. A winner's first name and last initial may be shown on our Prize Games page. Winners are responsible for any taxes on a prize.
  • Cheating. Fake accounts, automated activity, or any other cheating can lead to entries being removed and a winner being disqualified.
  • Changes. We may change, pause or cancel a game or promotion, or swap a prize for one of similar value, if we need to. Games and promotions are void where prohibited by law. They are not sponsored, endorsed or run by any social media company.

9. Affiliate program

Signed-in customers may apply to become affiliates. We approve or decline each application at our discretion. An approved affiliate receives a personal referral link and a dashboard.

  • Commission. You earn commission on eligible orders placed through your link within the tracking period we set. Your commission rate and how it is calculated are shown in your affiliate dashboard.
  • Refunds. If an order is refunded, returned, cancelled or charged back, the commission on it is taken back.
  • Payouts. We pay commission outside the Site, by a method we agree with you, and record each payout against your balance.
  • Rules. Do not place orders through your own link to earn commission on your own purchases, create fake or test orders, send spam, or mislead people about us or our products. Clearly tell people you earn a commission when you share your link, as US advertising rules require.
  • Independent role. You are an independent promoter, not our employee or agent, and you are responsible for your own taxes.
  • Changes and removal. We may change commission rates or program rules, and may suspend or end any affiliate account. Commission we believe came from fraud or a breach of these rules may be withheld or reversed.

10. Drop shipping program

Our drop shipping program lets approved businesses buy from us and have orders sent directly to their own customers. We approve each application at our discretion.

  • Tier discounts. Approved drop shippers receive a tier discount on everything in their cart at checkout. Tiers are based on the items or dollars you have sold, as shown in your dashboard, and you move up automatically when you reach the next tier. We may change tiers, and may move a member or lock them at a tier. The tier discount cannot be combined with coupon codes, and a sale price is never discounted twice.
  • Your customers. You are the seller to your customers. You are responsible for your prices, your customer service, your own taxes, and for following the law. You enter your customer's shipping address at checkout, so please check it carefully, because we ship where you tell us to. We include a plain packing slip with your business name and no prices.
  • Returns and defects. Section 7 applies to your orders with us. Your customers should contact you, not us, and you can then contact us about any problem with our work within the time stated in Section 7.
  • Artwork. Section 6 applies to any artwork you or your customers provide. You are responsible for making sure you have the rights to it.
  • Removal. We may suspend or end a drop shipper's membership for fraud, abuse, or a breach of these Terms.

11. Support tickets and messages

You need to be signed in to open a support ticket. Your tickets and our replies are kept in your account so you can follow them, and we may also email you about them. Please do not put full card numbers or passwords in a ticket or message.

You can attach up to 3 files to a message (JPG, PNG, GIF, WEBP or PDF only, within the size limit shown on the form). Only you and our staff can open them. We may remove attachments that break these Terms. We keep tickets and messages for as long as we reasonably need them for support and our records. We aim to reply quickly, but we cannot promise a response time. We may close a ticket, or suspend an account, if messages are abusive or are used to harass our team.

12. Acceptable use

When you use the Site you agree not to:

  • break the law or help anyone else do so;
  • use bots, scrapers or other automated tools to browse, buy, or take part in games or promotions;
  • try to break into, overload or interfere with the Site, its accounts or its security;
  • pretend to be someone else, or use someone else's payment method without permission;
  • dispute a valid charge in bad faith or abuse our returns or promotions;
  • upload anything harmful, such as malware.

We may suspend or end access, and cancel orders, if we believe these rules have been broken.

13. Our content and trademarks

The Site, including its text, images, designs, logos, product photos and software, belongs to us or our licensors and is protected by law. Wear It Loud and our logos are our marks. You may use the Site for your own personal shopping, but you may not copy, sell, or reuse our content without our written permission.

14. Privacy

Our Privacy Policy explains what information we collect and how we use it. By using the Site you also agree to it.

15. Disclaimers

To the fullest extent the law allows, the Site and our products are provided "as is" and "as available". We do not promise that the Site will always work without interruption or errors, or that it will be free of harmful components. Nothing in these Terms limits any rights you have under law that cannot be waived, such as legal guarantees that apply to defective goods.

16. Limitation of liability

To the fullest extent the law allows, we are not responsible for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost sales or lost data, arising from your use of the Site or our products. Our total responsibility to you for any claim is limited to the amount you paid us for the order the claim relates to. Some places do not allow these limits, so they may not apply to you.

17. Indemnity

You agree to protect and cover the costs of Wear It Loud and its owners and staff against claims, losses and expenses (including reasonable legal fees) that come from Your Artwork, your breach of these Terms, or your misuse of the Site, to the extent the law allows.

18. Governing law and disputes

These Terms are governed by the laws of the State of Maine, without regard to its conflict-of-law rules. If you have a problem, please contact us first at info@wear-it-loud.com and give us 30 days to try to fix it. If we cannot resolve it, any claim must be brought in the state or federal courts located in Maine, and you and we agree to those courts having authority over the dispute.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the new version here and change the "Last updated" date. Changes apply from the date they are posted. An order you have already placed stays under the Terms that applied when you placed it. If you keep using the Site after a change, you accept the updated Terms.

20. General

If any part of these Terms is found to be unenforceable, the rest stays in effect. If we do not enforce a part of these Terms right away, that does not mean we give it up. These Terms, together with our Shipping, Returns and Privacy pages and the rules shown on any game or program page, are the whole agreement between you and us about the Site. You may not transfer your rights under these Terms to anyone else without our permission.
